IMPORTANT: Jatta M Kommerce Private Limited (CIN: U58200MH2024PTC428411), a company incorporated under the laws of India and having its registered office at 1st Floor, Shop No.220, Building No.3, Citi Mall, Link Road, Andheri (W), Mumbai, Maharashtra 400053, India (hereinafter referred to as the “Company”, “We”, “Us”, “Our”) owns and operates the brand “Handloan.ai”.

The Company operates a website at www.handloan.ai (the “Website”) and may offer a mobile application (the “App”). The Website and the App are hereinafter collectively referred to as the “Platform”. The Company also operates as a Loan Service Provider on the Open Network for Digital Commerce ("ONDC"), and these Terms govern your use of our services whether accessed directly through our Platform or via the ONDC network. Company makes the Platform available for use by the end-users (hereinafter referred to as “User”, “You”, “Your”), subject to these Terms of Service.

The terms and conditions contained herein are hereinafter collectively referred to as “Terms”.

These Terms shall constitute a binding contract between the Company and You when You use the Platform or interact with our services through the ONDC network. By clicking the “I Agree” button or by accessing or using the Platform in any manner, or by initiating a transaction for our services through the ONDC network, You hereby undertake that You have read, understood, and accepted these Terms. Together with the Privacy Policy, these Terms constitute the entire agreement regarding Your use of the Platform and our services on the ONDC network.

If You do not agree to these Terms, You must not proceed to use the Platform or avail our services via the ONDC network.

Without prejudice to any other specific requirement in these Terms, Your use of the Platform or our services on the ONDC network shall be deemed a representation that You are above 18 years of age, of sound mind, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with them. The Company facilitates the provision of certain Services offered by different NBFCs, Banks, and other financial institutions partnered with the Company (“Lenders”).

THE COMPANY IS NOT A LENDER AND DOES NOT PROVIDE ANY LOANS OR OTHER CREDIT FACILITIES. THE COMPANY IS MERELY OPERATING THE PLATFORM AND PARTICIPATING ON THE ONDC NETWORK TO FACILITATE (A) YOUR APPLICATION TO AVAIL SUCH LOANS OR OTHER CREDIT FACILITIES; OR (B) YOUR ACCESS TO SUCH OTHER SERVICES.

Headings of clauses are for convenience only and shall not be used to interpret the contents. Please read these Terms in full.

A. Description of the Platform

The Company owns and operates the Platform that facilitates the provision of Services (as defined below). As a participant on the ONDC network, we enhance the discoverability and accessibility of financial products from our partner Lenders. The Company is merely an intermediary and does not directly provide any financial services to the Users. It is not an organization registered with the Reserve Bank of India (RBI) as a bank or Non-Banking Financial Company (NBFC), nor is it a financial institution under the Companies Act, 2013, the Banking Regulation Act, 1949, or any other applicable laws in India.

B. Applicability of the Terms

By using the Platform or availing our services through the ONDC network, You give Your unconditional consent to:

Our Privacy Policy, available on the Platform and incorporated herein by reference.

Any other policy or term of use made available on the Platform.

Applicable ONDC network policies, as amended from time to time.

These Terms may be amended at any time. All amendments shall be binding upon You once the updated Terms are made available on the Platform. Your continued use of the Platform or our services on the ONDC network constitutes acceptance of the amended Terms.

C. The Services We Provide

The Company provides the following services through the Platform and/or via the ONDC network ("Services"):

Facilitation of Credit Facilities: The Company facilitates the provision of personal loans and other credit facilities (collectively, the "Credit Facilities") offered by Lenders to potential borrowers. The Company collects information from You as required by the Lenders. The Platform and our ONDC storefront may reflect the Credit Facilities You are eligible for, and We facilitate the completion of loan applications, collection of KYC documents, and acceptance of loan agreements. You acknowledge that the decision to grant a loan rests solely with the Lender(s), and We provide no guarantee of approval. Funds are transferred directly by the Lender(s) to Your bank account upon approval. Your relationship with the Lender(s) is governed by their terms, and We are not liable for any acts or omissions of the Lenders.

D. Your Obligations

You shall use the Platform and our services on the ONDC network only for Your personal, non-commercial use and in compliance with all applicable laws.

You are responsible for maintaining the confidentiality and security of Your account and password.

You agree not to circumvent security features, upload malicious software, or use the Platform or ONDC network services for any unlawful or prohibited purpose, including fraud, money laundering, or posting unlawful content.

You shall not copy, modify, or reverse engineer any part of the Platform.

E. Intellectual Property

The Company is the sole and absolute owner of the Platform, including all content, trademarks, logos, and other intellectual property, excluding the ONDC brand and marks which are owned by the ONDC entity. You are granted a limited, non-transferable, revocable license to access and use the Platform for its intended purposes.

F. Disclaimer of Warranties and Limitation of Liability

THE PLATFORM AND OUR SERVICES ON THE ONDC NETWORK ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permissible by law, the Company disclaims all warranties, including merchantability and fitness for a particular purpose. We are not responsible for the availability, performance, or security of the underlying ONDC network infrastructure.

IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR OUR SERVICES ON THE ONDC NETWORK, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM NETWORK FAILURES, TECHNICAL GLITCHES, OR INTEROPERABILITY ISSUES ON THE ONDC NETWORK. If the foregoing limitation is not enforceable, the maximum liability of the Company shall be limited to Indian Rupees Five Hundred (₹500).

G. Indemnity You agree to indemnify and hold harmless the Company, its affiliates, officers, and directors from any claims, damages, or losses arising from: (i) Your use of the Platform or our services on the ONDC network; (ii) Your violation of these Terms; or (iii) Your violation of any third-party rights.

H. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms or your use of our services via the ONDC network shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
